These terms apply to every photography service provided by Mario Vastola, freelance photographer, P.IVA 12348100962, Naples, Italy ("I", "the Photographer") to the client ("you").

The written quote or agreement for your project forms part of these terms; where they differ, the quote or agreement prevails.

1. Booking and deposit

A booking is confirmed once you've accepted the quote in writing and paid the deposit stated in it. The balance is due on the day of the session or on delivery, as stated in the quote.

2. Rescheduling and cancellation

You can reschedule once, free of charge, up to 72 hours before the session. If you cancel, the deposit is retained to cover the date reserved and the preparation already done. If weather, illness or safety makes a session impossible, I'll offer a new date at no extra cost. If I have to cancel and can't offer a date that works for you, every payment you've made is refunded in full.

3. Delivery

Edited images are delivered through a private online gallery within the time stated in your quote. I keep artistic control over selection, colour grading and retouching. For private sessions, unedited (RAW) files are not supplied. For commercial work, the files and formats delivered are those set out in the license.

4. Copyright and use

All images and drone footage remain my intellectual property under Italian law (Legge 633/1941) and international copyright law. Private clients receive a personal licence: sharing, printing and personal use. Any commercial use needs a written licence, which defines use, territory and term. I may show selected images in my portfolio, website and social media, unless you ask me not to in writing before the shoot. Boudoir and intimate images are never published without your explicit written consent.

5. On the day

Please arrive on time. Delays of more than 30 minutes may shorten the session. I may end a session if conduct on set becomes unsafe or inappropriate.

6. Lost-place sessions

Lost-place sessions take place in disused buildings. Before booking, I tell you how access to the proposed location is arranged. On site, you agree to follow my safety instructions, to stay out of any area I mark as off-limits, and to wear the footwear agreed in advance. Nothing may be forced, damaged or removed. If anything is damaged, or if your conduct puts either of us at legal or physical risk, I may end the session immediately; in that case the fees paid are retained.

7. Liability

I take every reasonable care with you, your belongings and your images. My liability for loss of images caused by equipment failure, theft or accident is limited to the fees you've paid. Nothing in these terms limits liability for death or personal injury caused by negligence, for gross negligence or willful misconduct, or any right you have as a consumer that cannot be excluded by law.

8. Your rights as a consumer

If you book as a private individual resident in the EU, you keep every protection that the mandatory law of your country of residence gives you.

9. Personal data

Personal data is handled under the GDPR, as described in the Privacy Policy.

10. Governing law

These terms are governed by Italian law. For business clients, the court of Naples has exclusive jurisdiction. Consumers may also bring proceedings in the courts of their country of residence.
